The conduct of the Ceres Gleann Declarants, HOA Board and possibly others against the senior citizen homeowners is egregious to the extent that I sincerely believe it meets the legal definition of attempted theft, attempted extortion, and "racketeering activity" in the state of Oregon. Much of the basis for this belief is contained on the various pages of this website, especially in "Home Foreclosure, Liens & Other Penalties" and "Racketeering the HOA Way" pages, which thoroughly explain my belief. This picture was taken May 10, 2009, after the landscape maintenance company
(Mark Cavender - doing business as Total Landscape Care) sprayed for weed
grasses. Homeowners in Ceres Gleann currently pay a landscape maintenance
assessment of either $960 or $1,080 per year for "professional" landscape
maintenance. If you do your own landscape maintenance, or use a company
other than Total Landscape Care TLC), you must still pay the landscape
maintenance assessment, even though you receive no services in return. The
landscape maintenance assessment is in addition to the Homeowner Association assessment, which is $450 for 2011 - it was only $180 when I moved to Ceres Gleann in 2007.
As the result of landscape damage in 2009, including that shown above and in other pictures throughout this site, I requested proof that Mark Cavender / Total Landscape Care maintains the comprehensive liability insurance coverage required by the contract. Mr. Cavender refused to provide that evidence to me. For that reason,
plus failure to provide all contracted for services and the damage caused by TLC, I terminated his services - that's when my problems began.
On April 10, 2010, Mike Stewart, a member of the Ceres Gleann Board of Directors finally provided documentation that TLC has the required liability insurance coverage. I mention this here because I believe it is extremely important that buyers confirm all necessary insurance is in place before buying, rather than after (my mistake). I am greatly concerned that my
experience reflects a growing new trend in financial schemes directed against older people residing in HOA developments. The actual cost to a homeowner is unbelievably excessive and the penalties that can be levied are a financial atrocity that can lead to the loss of equity in your home, or even foreclosure.

Fowler brought his attorney to the 2010 HOA Annual Meeting to warn
homeowners that the HOA could foreclose on their homes, if all assessments were

Had I known that the Declarants could dictate just about every meaningful thing pertaining to my property, I would never have bought in Ceres Gleann.
The purpose of this website is to forewarn and provide others with information so they can investigate
the property rights they give up and potential problems, as well as possible advantages, before purchasing in Ceres Gleann or similar
Homeowner Association developments, also known as Planned Unit Developments (PUD). Hopefully it will help prevent them from having an experience similar to mine.
You should do your own research, and obtain competent legal counsel to be sure
you understand your rights, responsibilities and the limitations on your
property rights that exist in an HOA development BEFORE you purchase
a home or lot in one. If the HOA is controlled by the Declarants
and/or has landscape maintenance or other unnecessary assessments, buying in
such a development may not be a wise investment.

UPDATE: I was recently asked 'what would it take for me to shut down my
