Click here to learn about the $200,000 LAWSUIT filed against Fowler Homes, and Fowler Homes' response. Hint:  Fowler Homes denies it was the contractor (but states it WAS the construction manager and site superintendent), denies liability for a variety of reasons, and claims James W. Fowler Co., Clearspan Truss, Inc., Home Comfort, Inc., and David Kerns Construction, Inc. are the responsible parties.   Sure doesn't match the Fowler Homes web advertisements does it?Click here to view a Fowler Homes ad.

UPDATE:  The lawsuit against Fowler Homes has once again been re-set.  It was originally scheduled for a trial by jury beginning July 17, 2012 at the Polk County Courthouse.  But, Fowler Homes got a new attorney, so the trial was re-set for September.  I learned this morning, that it has been FURTHER DELAYED and is now scheduled to start at 8:00 a.m. on November 26, 2012.  I have no way of knowing if Fowler Homes changed attorneys to delay the trial or if the previous attorney resigned.  Also, I have no way of knowing how / why Fowler Homes got the trial delayed again.  But, I cannot think of any reason other than resignation by the attorney, or a change in attorneys to deliberately delay the trial, as to why this case keeps getting re-set.  If you are interested in attending, be sure to call the courthouse at 503-623-3154 before the beginning of November 2012 to make sure the case has not beeen settled or re-scheduled yet again!

Click on "New Atrocities & Updates"  for information on the CRIMINAL COMPLAINT that I filed against James Fowler, the HOA Board and others; the "request" from Caleb Williams, the attorney for James Fowler and the HOA, that I take down this website; why the $2,450+ in LAWYER FEES that the HOA has charged to my residence are in violation of Oregon Law; my 3-2-11 meeting with the HOA Board, and other updates on problems encountered by myself and others living in Ceres Gleann.  On pages throughout this site you can learn about the financial atrocities that I've experienced since moving to Ceres Gleann in October 2007.  In my opinion, these financial atrocities are examples of how Mr. Fowler, Declarant and President of the Ceres Gleann HOA, attempts to impose his control on the HOA.  Please see all pages of this site for details and warnings intended to help you protect your investment and your heirs before you decide to buy in an HOA.  The HOA Board has placed a lien on my residence, based on a $250 fine that was not legally imposed, and the amount claimed under this lien now over $4,500.  The lien is not legal because the HOA Board did not follow the requirements of Oregon Statutes or the HOA's own Bylaws before imposing it.  The Board has repeatedly refused to correct this unlawful act.  Click here to see why I believe a homeowner is in danger of having an HOA take their equity through unlawfully imposed fees.

The conduct of the Ceres Gleann Declarants, HOA Board and possibly others against the senior citizen homeowners is egregious to the extent that I sincerely believe it meets the legal definition of attempted theft, attempted extortion, and "racketeering activity" in the state of Oregon.  Much of the basis for this belief is contained on the various pages of this website, especially in "Home Foreclosure, Liens & Other Penalties" and "Racketeering the HOA Way" pages, which thoroughly explain my belief.  Click Here to go to the American Homeowner Resource Center site, to learn more about HOA Racketeering across the USA.  You can also do a Google or Yahoo! search on the terms Racketeering +HOA to learn how rampant this problem is.

This website is owned solely by me, and I am solely responsible for its content.  The factual documents and photographs speak for themselves.  Any opinions expressed anywhere on this website are my own personal opinions, which have been developed based on those documents and photographs and my personal knowledge.

This picture was taken May 10, 2009, after the landscape maintenance company (Mark Cavender - doing business as Total Landscape Care) sprayed for weed grasses. Homeowners in Ceres Gleann currently pay a landscape maintenance assessment of either $960 or $1,080 per year for "professional" landscape maintenance.  If you do your own landscape maintenance, or use a company other than Total Landscape Care TLC), you must still pay the landscape maintenance assessment, even though you receive no services in return.  The landscape maintenance assessment is in addition to the Homeowner Association assessment, which is $450 for 2011 - it was only $180 when I moved to Ceres Gleann in 2007.

As the result of landscape damage in 2009, including that shown above and in other pictures throughout this site, I requested proof that Mark Cavender / Total Landscape Care maintains the comprehensive liability insurance coverage required by the contract.  Mr. Cavender refused to provide that evidence to me.  For that reason, plus failure to provide all contracted for services and the damage caused by TLC, I terminated his services - that's when my problems began.

On April 10, 2010, Mike Stewart, a member of the Ceres Gleann Board of Directors finally provided documentation that TLC has the required liability insurance coverage.  I mention this here because I believe it is extremely important that buyers confirm all necessary insurance is in place before buying, rather than after (my mistake). I am greatly concerned that my experience reflects a growing new trend in financial schemes directed against older people residing in HOA developments.  The actual cost to a homeowner is unbelievably excessive and the penalties that can be levied are a financial atrocity that can lead to the loss of equity in your home, or even foreclosure.  Go to the "HOA Board and Financial Records" page for details on how James W. Fowler brought his attorney to the 2010 HOA Annual Meeting to warn homeowners that the HOA could foreclose on their homes, if all assessments were not paid.  Webpages with more details can be accessed from the navigation bar on the left.  Had I known that the Declarants could dictate just about every meaningful thing pertaining to my property, I would never have bought in Ceres Gleann.

The purpose of this website is to forewarn and provide others with information so they can investigate the property rights they give up and potential problems, as well as possible advantages, before purchasing in Ceres Gleann or similar Homeowner Association developments, also known as Planned Unit Developments (PUD).  Hopefully it will help prevent them from having an experience similar to mine.

You should do your own research, and obtain competent legal counsel to be sure you understand your rights, responsibilities and the limitations on your property rights that exist in an HOA development BEFORE you purchase a home or lot in one.  If the HOA is controlled by the Declarants and/or has landscape  maintenance or other unnecessary assessments, buying in such a development may not be a wise investment.

All photos are actual and have not been retouched. All documents are factual and have not been changed, except for removing names and addresses of homeowners, or re-formating for display on the Internet.   My opinions are clearly identified as such, and I include them in this site under the free speech rights and protections afforded me by the First Amendment of the Constitution of the United States. The site is still under construction, but you may e-mail me at Robert@CeresGleannLife.info if you have questions.  Thank you.

I am an 81 year old veteran, somewhat the worse for wear.  However, I'm not too old to fight the financial atrocities that I have experienced in the Ceres Gleann Homeowners Association.

If any of my opinions expressed anywhere in this website are incorrect, anyone is welcome to provide me proof of the corrections and I will update this website.  Robert@CeresGleannLife.info  UPDATE:  I was recently asked 'what would it take for me to shut down my web site and remove my comments from the web sites.'  However, no evidence that any of my comments are not accurate accompanied this request.  I responded to the effect that as long as James W. Fowler was involved in the Ceres Gleann HOA management, I would not take the site down.

Because I have defended my right of free speech and refused to take down this website, the Ceres Gleann HOA has created its own site ceresgleannhoa.com.  Please feel free to see if they have provided any proof that my opinions are not well founded at www.ceresgleannhoa.com.
